Employers – Don’t Violate The Fair Labor Standards Act – Not Even By Accident
The Fair Labor Standards Act or FLSA affects most employers both public and private. Two of its most recognized requirements are that non-exempt employers must pay employees the federal minimum wage of $7.25 per hour worked and time and a half for any work in excess of 40 hours. BUT! Did you know that you are probably required to hang posters in your place of business??? That’s right. Several laws administered by the Department of Labor require employers to display official DOL posters where employees can readily observe them. And if you’re thinking “Whose going to say anything?” well think about this: if an employee, even frivolously claims you didn’t pay due overtime or perpetrated wrongful termination, you’ve just given their lawyer another arrow to shoot at you. On top of that, failure to post some posters carries with it civil money penalties.
Take the YOUR RIGHTS UNDER THE FAMILY AND MEDICAL LEAVE ACT poster which public agencies, elementary and secondary schools, and any private employer employing 50+ employees in 20 or more workweeks is required to post. By not complying, the entity is subjecting itself to possible civil money penalties assessed by the Wage and Hour Division.
